GENERAL CONTRACTING CONDITIONS

These General Conditions of Contract (hereinafter, “ CGC”) are intended to regulate the use of the online store www.herooj.com (hereinafter e indistinctly, “Online Store”, “Website” or “Website”) owned by ISOCEANPOWER, S.L. (hereinafter, “ ISOCEANPOWER” or “HEROOJ”) by, as well as the terms and requirements that it must comply with throughout the purchase process.

ISOCEANPOWER makes available to those interested parties who access and register in this Online Store (hereinafter, “Buyer/s” or “Client/s”), the possibility of carrying out purchases of the products offered through the website www.herooj.com (hereinafter, the “Products”).

The acceptance of these CGC implies the conformity and acceptance of the Client of the integrity of each and every one of the sections described here.

These GTC will have an indefinite validity period and will be applicable to all contracts made through the website www.herooj.com.

ISOCEANPOWER reserves the right to unilaterally modify, and at any time, these GTC without affecting the products acquired prior to the modification.

These General Conditions of Contract (hereinafter, the “CGC”) have the function of regulating the relationship between ISOCEANPOWER and the Clients, regarding all the transactions carried out through of the online store website.

Client will be understood as the Internet user who acquires this condition by registering on the Website, using the corresponding form and to whom a Client code and password are assigned, for which he or she is fully responsible for the use and custody, being responsible for the veracity of the personal data provided to the provider, as we will see in the Client Registration section.

  1. LEGAL FRAMEWORK

In compliance with current regulations, in accordance with the provisions of Law 34/2002, on Services of the Information Society and Electronic Commerce, Law 7/1998 on General Conditions of Contract, Royal Legislative Decree 1 /2007, of November 16, which approves the Consolidated Text of the General Law for the Defense of Consumers and Clients and other complementary laws and Law 7/1996 on the Regulation of Retail Trade, the entity ISOCEANPOWER, S.L. that operates through the internet from this website www.herooj.com, details below the General Conditions of Contract of the products offered through it and those that generate the rights and obligations of the parties.

  1. ACCEPT

By accepting these GTC, the Client declares that he is a person with the capacity to contract according to current regulations and that he has read and accepts these GTC.

  1. AVAILABILITY

The Client will always have access, and in any case, prior to the start of the product contracting procedure, to the CGC, which may be stored and/or reproduced on a durable medium

  1. VALIDITY OR DURATION

The period of validity or duration of these CGC, will be the time that they remain published on the mentioned website and will be applicable from the moment the Client makes use of the Website, and/or proceeds to the hiring of any products.

  1. MODIFICATIONS

The Provider reserves the right to unilaterally modify said CGC, without this affecting the goods or promotions that were acquired prior to the modification by the Client.

The Client undertakes to carefully read the CGC each time he proceeds to contract a product, given that they may have been modified since the last time he accessed.

  1. NULLITY

If any clause included in these CGC is declared totally or partially null or ineffective, such nullity will affect only said provision or the part of it that is null or ineffective, subsisting in everything else the CGC.

  1. OBJECT OF THE CONTRACT

The purpose of this Agreement is to regulate the contractual relationship of sale born between the Provider and the Client from the moment the latter accepts the purchase during the online contracting process through the mechanisms set forth below.

The contractual relationship of sale entails the delivery, in exchange for a certain price and publicly displayed through the website, of one or more specific products. Each of these products may be subject to a specific regulation through the particular contracting conditions of each of them, of which more detail will be given in the guarantee, returns, withdrawal section, or in the product's own technical data sheet. due to the different formats in which the products are marketed, their packaging or their very nature.

  1. CUSTOMER REGISTRATION

The Client may register on the web by clicking on the upper left button "Register", for which he will enter the personal data required as mandatory, which are: name, surnames, email and password. Registering as a Customer of the store will provide you with access to the web, to the acquisition of products and to the reception of informative bulletins/newsletters with information about the company, as well as its products.

The Client will designate a username and a password committing to make diligent use of them and not to make them available to third parties, as well as to notify the Provider of the loss, theft or possible access by an unauthorized third party, in such a way so that the provider proceeds to the immediate blocking and restoration of the Client's account.

The Client has full responsibility for its use and custody, being responsible for the veracity of the personal data provided to the Provider.

The Client may not choose as username those words that are intended to confuse others by identifying him as an integral member of the Provider, as well as profanity, insulting expressions and, in general, contrary to the law or the requirements of the morals and good conduct.

  1. GEOGRAPHICAL SCOPE

This website www.herooj.com operates and sells only in mainland Spain and the Balearic Islands.From now on, this geographical area will be understood as "the Territory". Therefore, only shipments are made and products are distributed in the aforementioned Territory. However, in the event that there is a Customer who is interested in our products and belongs to a geographical area in which HEROOJ does not have online sales, we suggest that you contact our Customer Service and we will try , if possible, reach an agreement so that you can enjoy our Products.

The use of this website, as well as any purchase made on it, is considered made in Spain, and therefore subject to current Spanish laws and regulations. The Provider does not accept or deliver orders outside the national Territory.

All of the above is indicated without prejudice to the fact that we will soon be able to offer these services in the excluded areas, in which case it will be announced in advance on this website.

  1. PRODUCT INFORMATION

The Provider pays great attention to the information regarding the characteristics of the products through technical descriptions from its collaborating companies and manufacturers, and photographs that illustrate the products. All this is done within the limits of the technique and respecting market standards.

  1. PURCHASE PROCESS

In order to start the purchase process at www.herooj.com, you must first register as a Client, pressing the button that appears on the main page of the Website “Register” and filling in the mandatory information that they are requested on the page that will appear next. After registration, you will be assigned a Client name and password automatically.

The registration system is not provided with a Client verification system in the registration process. So that before the activation of the Client in the system, a welcome message is sent to the email in order to confirm the veracity of the Client. Once correctly registered, the Client will be able to enter with his username and password to the control panel of his profile to be able to manage all those functions that the Provider of the page has made available to him.

Once you have registered, you can proceed to purchase your products, which will be completely electronic.

The purchase process is easy and simple:

  1. PRICES, OFFERS AND DISCOUNTS

The prices indicated for each Product will be expressed in the Euro currency (€).

The prices indicated next to each Product include VAT and can be viewed from the beginning of the purchase. In case of making any offer, discount or promotion, it will be reflected on this website and you will be able to opt for it.

This price may increase from the price initially displayed at the time you added the Product to your basket. Therefore, the fact of adding a Product to your basket does not mean that you can buy it at the price displayed at that time. On the other hand, it is also possible that the price of the Product will drop since you added it to your basket.

The prices shown on the web based on an obvious typographical error, such as, for example, products published with a price of zero euros or at an insignificant or ridiculous price will not be part of the order and the existence of the error will be communicated to the customer at as soon as possible.

  1. DELIVERY AND SHIPPING COSTS

The delivery of orders will be made at the delivery address freely designated by the Customer. In the registration process, you can indicate a different address where you can receive your orders.

The products purchased will only be shipped when full payment has been made and received. In the meantime the receipt of payment does not take place. the purchase will not be understood as made.

It is possible that one or more of the Products associated with your order are not available at the time of processing it. In the event that the selected Product is not available, the refund will be made as soon as possible and in the case of offering an availability date, the new delivery period will be informed, being able to choose, if you wish, for this new term. , for the refund of the purchase amount, or for obtaining a product with similar or superior characteristics. HEROOJ does not assume any responsibility when the delivery of the Product does not take place as a result of the data provided being false, inaccurate or incomplete or when the delivery cannot be made for reasons beyond HEROOJ's control, such as the absence of the recipient or retention of the shipment in customs In no case, this delay will entail the obligation to compensate any sum.

For orders less than €35, a shipping cost of €3.90 will apply. Shipping costs are free if your order exceeds €35, except for shipments to the Balearic Islands, with specific conditions detailed below:

New customers have the possibility to place the first order without shipping costs.

We have urgent transport for the Peninsula and the Balearic Islands. This home delivery option allows you to receive your package in 24/72h (working days) with different transport agencies. If your order is placed before 7:00 p.m., it will be processed the same day, as long as the product is available in our warehouse.

Shipments will not be made to PO boxes.

  1. DELIVERY TIME

The period of preparation of the shipment will be from 24 to 48 hours and will include the validation and verification of your data and payment, preparation of the order and collection by the transport company.

The period of transport and delivery of your order will be as indicated, ranging from 1 to 3 business days if the destination is Spanish territory. If the destination is within the European Union, it will be from 3 to 7 business days.

In case you do not receive the package within the indicated period, an investigation will be carried out together with the carrier that could last several days (the approximate period is fourteen (14) business days). During this period, no reshipment or refund of the order can be made.

  1. TAXES AND CURRENCY

The R.P.V.P (retail price) of items with a delivery address to the Peninsula and the Balearic Islands includes VAT

The prices indicated for each product include the corresponding taxes and in any case will be expressed in the Euro currency (€). These prices, unless expressly stated otherwise, do not include shipping costs or any other additional services and annexes to the purchased product.

  1. HOW TO EXTEND OR CANCEL MY ORDER

To extend an order you can do so as long as you have not completed the purchase and you can do so by pressing the "Continue shopping" button.

To cancel an order after making a purchase, it can be canceled with the right to a full refund as long as the following conditions are met:

  • The order has not left our warehouses nor is it in transit to the indicated address
  • For orders that have left the HEROOJ facilities, the courier company will be notified and in this case, the amount returned to the customer would be in full except for shipping costs.

To request the cancellation of your order you must send an email to the address [+]@herooj.com.

The order can also be canceled from the Client's profile at www.herooj.com. To do this, the Customer must locate the order from the profile in their purchase history, provided that the conditions indicated above are met, the money will be returned to the same credit/debit card with which the purchase was made, within 24-48 business days.

  1. LANGUAGE IN WHICH THE CONTRACT IS DEVELOPED

The contracting procedure and the pre-contractual information is in Spanish and this language will be used to carry out the contracting.

  1. INVOICE

The invoice can be viewed and downloaded from the Customer's control panel. For this download, the Client must go to "My account", "Order history", after locating the shipment, the Client can do it in "Details" and later by clicking on "Download your invoice as a PDF file".

  1. PAYMENT METHODS

The Client may choose the following forms of payment:

  • Credit/debit card for which you will provide the following data:
  • Name and surnames;
  • Card number;
  • CVV/CVC;
  • Card expiration date.

Your card information will be forwarded directly to the payment service provider Shopify. This entity accesses your identification data as a buyer and the data of the purchase made related to the payment process.

Using this payment method, HEROOJ does not collect or process any Customer data related to the card number. All data is processed directly by the payment service provider Shopify so that HEROOJ can always offer the greatest transparency and confidentiality in the transaction.

The payment of the order will be made directly with said entity, thus offering maximum security.

In the event that the payment platform informs of the denial of the card, the order will be automatically cancelled, informing the Client of its cancellation at the time. Payments cannot be made with cards issued outside Spanish territory. Your card details will not be stored in our database, since when they are filled in they will be on the secure website of the chosen bank.

  • PayPal: Your card details will be stored securely within your PayPal account, and you can use your account on our website.
  • Electronic wallet: Apple Pay or Google Pay.
  1. RETURNS

In accordance with current legislation, HEROOJ will reimburse you the price of the Product and the commission expenses, within a period of (14) calendar days following receipt of the merchandise by the Client. To do this, the conditions set out on this page of conditions must be met.

HEROOJ will use the same means of payment that you would have used for the initial transaction, unless another means is expressly agreed upon.In any case, the reimbursement of the price will not entail the obligation to pay any fee or commission

The Buyer must bear the direct costs of returning said Products and will be responsible for the decrease in the value of the goods resulting from handling them other than what is necessary to establish their nature, characteristics or operation.

The transport costs originated by the return will be borne by you. Collection costs in the peninsula amount to 4.90 euros and in the Balearic Islands to 6.90 euros. However, the Consumer is free to choose and search for the agency that best suits your needs or offers you the most competitive rates.

All merchandise must be returned in perfect condition, keeping all its accessories in their original conditions (accessories, cases, boxes, guarantees, certificates, etc.), in their packaging – you must, as far as possible, use the same packaging- and protected, avoiding stickers, seals or adhesive tapes directly on the surface or packaging of the item.

Once the return form has been filled out and sent, the Client will receive the instructions in his email so that he can send it to our facilities. You must send the product(s) within a maximum period of 15 days from when you notify us of your desire to exercise the right to return.

Once the merchandise has been received and verified that it is in perfect condition, the refund of the amount will be processed. The payment received will be returned, including the cost of delivery with the exception of the additional costs resulting from the choice by the Client of a delivery method other than the least expensive method of ordinary delivery that we offer. The payment will be made within a maximum period of 30 calendar days from when you exercise your right of withdrawal. Until we have received the products, we can withhold the refund.

As an exception to the above, the following may not be returned, unless they are defective:

  • Products that do not allow their return due to hygienic or health protection reasons if they have been unsealed after delivery (for example, cosmetic products, masks, etc.) or that were, after delivery, inseparably mixed with others Products.
  • The supply of sealed goods that are not suitable to be returned for reasons of health protection or hygiene and that have been unsealed after delivery.

  • Goods made to your specifications or clearly personalized.
  • Loose accessories that complement other main base products.
  • Products made according to the specifications of the consumer and Client or clearly personalized.
  • Products that after delivery and taking into account their nature have been mixed inseparably with other goods.
  • Items identified as gifts, for example, those sent free of charge or at no cost to the customer by HEROOJ.
  • The supply of digital content that is not provided on a material support when the execution has begun with the prior express consent of the consumer and Client with the knowledge on their part that consequently they lose their right of withdrawal.
  1. LEGAL GUARANTEE

All Products offered on our website are guaranteed against manufacturing defects for two (2) years from the date of delivery. The Consumer must inform us of the lack of conformity within two months from the date of delivery. knowledge of her.

The warranty does not include damage caused by misuse or normal wear and tear.

The Client will have the right to repair, replacement, price reduction or refund of the amount, and whose procedures will be free.

To enjoy the guarantee of the Products, the Consumer must reliably prove the purchase by providing any of the following documents: proof of purchase, purchase invoice, proof of payment.

These CGC are governed and interpreted by Spanish law.

The parties submit for the resolution of conflicts or possible controversies that may arise to the Courts and Tribunals of the Client's domicile.
